Stephen Test is a partner in the Litigation Department at Williams Mullen. A trial attorney in Virginia since 1979, he focuses his practice on civil, construction and commercial litigation in state and federal courts. Mr. Test has tried many jury and non-jury cases as well as administrative hearings, arbitration proceedings, mediations and appeals. He represents and defends individuals, businesses, partnerships and corporations in complex commercial disputes.

Representations
- Defended an organ procurement organization in Eastern Virginia in an action brought by a hospital and a waiting heart transplant patient alleging failure to comply with federal regulations for fair procurement and distribution practices of donated human hearts. This case presented issues of first impression on a national level relating to federal legislation for the procurement and distribution of donated human organs.
- Defended a client in a jury trial against a claim for breach of a commercial lease and damages. The case involved oral modification of written lease provisions and proof of knowledge and waiver of those provisions by the landlord.
- Represented a contractor in a breach of contract action brought against a condominium owners' association. The trial involved issues of the condominium owners' selection of an inappropriate and defective paint product for application to the outside of an oceanfront high-rise condominium.
- Defended a residential real estate developer against a claim brought by a former partner for fraudulent conveyances and misappropriation of company funds.
- Defended a general contractor in a construction dispute involving issues of first impression in Virginia courts. The defense of "pay-when-paid" language in construction contracts was recognized for the first time by the Virginia Supreme Court.
