Construction Litigation
Members of the Williams Mullen government contracts team have worked with construction project litigation arising from federal, state and local construction development. Our lawyers work with clients to identify issues and risks associated with construction projects that may affect the litigation, such as the Miller Act and federal labor laws such as the Davis-Bacon Act. We have assisted clients in assembling pre-litigation claims involving complex construction projects, overseeing the input of technical, cost and schedule experts. We interface with government contracting representatives to resolve construction claims and ensure that the client’s schedule and cost claims are recognized. When litigation occurs, our lawyers have worked on disputes both at the prime contractors and subcontractor levels involving large and small construction projects.

Representative transactions include:
- Represented subcontractor in litigation against surety of bankrupt prime contractor involving recovery of unpaid progress payments and retainage following termination of large chemical demilitarization facility contract. Successfully recovered full amount of progress payments and retaining.
- Represented contractor in dispute against Virginia Department of Transportation involving claims related to bridge repair work.
- Represented prime contractor in dispute against Metropolitan Washington Airports Authority involving claims related to project overruns, resulting in successful recovery of claimed amounts.
