Dean Barclay focuses his practice on trade relief and customs-security issues, but his experience also includes trade policy, export compliance, other regulatory matters and civil litigation.
In the area of trade relief, Mr. Barclay has helped the firm represent domestic and foreign clients during antidumping (unfair pricing) and countervailing duty (unfair subsidies) investigations. In customs and security, he has counseled clients seeking: to understand rules of origin, valuation, tariff classification and trade preference programs; to navigate the complexities of compliance audits, prior disclosures and penalties cases; to develop internal compliance programs consistent with post-9/11 homeland security regulations; and to participate in anti-terrorism initiatives like the Customs-Trade Partnership against Terrorism.
In the area of investigations, Mr. Barclay participated in an internal investigation by one of the world’s leading trade inspection, security and certification companies involved in the U.N. Oil-for-Food Programme. He also represented the company as it served as a witness in investigations conducted by the United Nations and U.S. congressional committees.
His representations have involved proceedings before the U.S. Court of Appeals for the Federal Circuit, the U.S. Court of International Trade, the Department of Commerce, the International Trade Commission, the Office of the U.S. Trade Representative, U.S. Customs and Border Protection and other federal agencies. Mr. Barclay is also admitted to practice before the U.S. Court of Appeals for the Fourth Circuit, the Virginia Supreme Court and the U.S. Supreme Court. He is a member of the District of Columbia Bar and the Virginia State Bar.
Before joining Williams Mullen, Mr. Barclay was an associate professor of English (Tenured) at Elmhurst College from 1987-1999 and received the Elmhurst College Excellence in Teaching Award. He is the author of several plays and of such articles as “Dead Hands and State Actors: The Racially Discriminatory Charitable Trust in Hermitage Methodist Homes,” Race & Ethnic Ancestry Law Journal, Volume 7 (2001).
Mr. Barclay received his bachelor of arts degree in English, with high honors, from Haverford College. He received his master of arts and doctor of philosophy degrees in English from Harvard University. He earned his juris doctor degree, cum laude, from Washington and Lee University School of Law, where he was the recipient of the Millhiser Scholarship. While in law school, Mr. Barclay was a finalist in the Mock Trial and Best Brief Competitions and a semifinalist in the Appellate Advocacy Competition.
