Pre- and Post-Award Disputes
Our attorneys have successfully represented clients in pre- and post-award disputes before a wide-range of government agencies and courts including the Government Accountability Office, the United States Court of Federal Claims, and administrative and judiciary matters in many states and municipalities. Our team is experienced in pursuing bid protest litigation both on behalf of disappointed bidders seeking to undo an award and awardees seeking to protect their new contract. We also have represented clients in disputes arising from contract performance, including litigation before courts and agency boards of contract appeals. In addition, our attorneys have been involved in alternate dispute resolution of contract performance issues.
Our representative transactions include:
- Successfully defended ship repair company in protest of award of multi-million dollar ship repair contract by the Navy before the Government Accountability Office.
- Represented vessel owner of well-maintained fifteen-year-old vessel in protest against U. S. Military Sealift Command solicitation for vessel charter that unnecessarily limited the competition to vessels less than ten years old. As a result of the protest, the solicitation was amended to permit the client to bid.
- Represented provider of vehicle and equipment maintenance services in protest against solicitation that was vague and ambiguous. Army cancelled and re-issued solicitation with terms that allowed client to implement its bidding strategy.
- Represented contractor that maintains state roadways in protest against state agency solicitation that contained inconsistent evaluation criteria. State agency cancelled, amended, and reissued solicitation.
