Careful attention to a contractor's rights under a contract or subcontract can have a substantial impact on profitability. Williams Mullen provides valuable counseling during contract performance to avoid problems, resolve disagreements before they become disputes, and help position clients for the best possible resolution of unavoidable disputes. Our lawyers are well versed in claims preparation and litigation, and they are experienced in handling cases before Boards of Contract Appeals, the United States Court of Federal Claims, and other federal and state courts. Our team also has been successful in overturning default terminations through litigation and through presentations to agency officials that result in a negotiated resolution, thereby avoiding the expense of litigation. Although our attorneys have extensive experience with traditional litigation, we encourage the use of alternative means of resolving disputes, such as mediation and arbitration, when it is in our client’s best interests.
Our representative transactions include:
- Represented utility company in spent nuclear fuel litigation arising under Nuclear Waste Policy Act before United States Court of Federal Claims.
- Negotiated successful settlement of claims arising from performance of base support services contract in Iraq, resulting in conversion of termination for default to termination for convenience and multi-million dollar payment by government.
- Successfully represented contractor in appeal before Armed Services Board of Contract Appeals of claim related to payment of German social tax on contract employees.
- Obtained favorable resolution of $16 million contract dispute with government for recovery of contract costs, fees and expenses.
- Obtained favorable resolution of $1 million contract dispute with government for recovery of contract fees and expenses.
- Represented client that provided industrial services to Defense Logistics Agency in Europe and had its contracts terminated for default following its alleged abandonment of its leased facilities. Achieved no-cost settlement that allowed client to avoid liability for Government’s reprocurement costs.
- Obtained favorable settlement netting our client over $3 million after resolution of contract dispute. In litigation filed on behalf of our client, resolved the matter by mediation resulting in a lump sum payment of over $3 million. Client was awarded additional work by the defendant company.
- Negotiated settlement of real estate tax assessment appeal by real estate company against General Services Administration arising from lease of office building to federal government.
