False Claims and Internal Investigations
Our attorneys have significant experience working with clients to respond to allegations of violations of the False Claims Act. We have engaged in extensive internal investigations to determine the basis for allegations of civil or criminal violations. We negotiate with government prosecutors and investigators to limit the impact of any criminal or civil investigation. Our attorneys also have defended clients in qui tam actions brought by company employees for alleged wrongdoing.
Our representative transactions include:
- Negotiated successful removal of suspension imposed on freight forwarder by Army and other military agencies arising from false claims investigation. Also achieved temporary restraining order against government agencies from imposition of suspension proceedings.
- Successfully resolved government-filed civil false claims against a major transportation contractor. Represented a joint venture (foreign corporation and Midwestern corporation) and defended against a government action alleging that the JV filed false claims concerning a large AMTRAK contract. Successfully resolved over $500 million dollars in claims while avoiding criminal action and adverse administrative actions, including suspension and debarment. Authored compliance plans approved by DOT.
