Monica McCarroll
Monica McCarroll focuses her practice on commercial litigation, with an emphasis in eDiscovery issues. She also has experience with IP litigation, fiduciary litigation, and tax litigation. She has tried numerous cases in state and federal courts and has argued before the Supreme Court of Virginia. Ms. McCarroll is admitted to practice in all Virginia courts, the U.S. District Courts for both the Eastern and Western Districts of Virginia, the U.S. Bankruptcy Court for the Eastern District of Virginia, and the U.S. Court of Appeals for the Fourth Circuit. Ms. McCarroll is also a member in good standing of the state and federal courts in New Jersey.

As co-chair of the firm’s eDiscovery Team, Ms. McCarroll has managed large electronic discovery projects in numerous complex commercial cases. She also has provided eDiscovery guidance for clients during internal investigations and employment-related claims. Ms. McCarroll has helped clients prepare for eDiscovery before litigation by developing email retention and litigation hold policies. She also has utilized the latest technology tools to help clients present evidence in the best light, whether at a deposition, at trial or in a settlement conference. Ms. McCarroll has been a frequent speaker and writer on eDiscovery issues. Her most recent article, “What Not to Do When Served with a Rule 45 Subpoena in the Age of eDiscovery” was published in the January 2010 edition of the ALI-ABA publication, “The Practical Litigator.”
Ms. McCarroll has been named one of the top up-and-coming lawyers in the state by Virginia Super Lawyers Rising Stars magazine and is listed in Virginia Business magazine as one of Virginia’s “Legal Elite.” She is a member of the Virginia State Bar, the American Bar Association, the Richmond Bar Association and The John Marshall American Inn of Court. As a member of the Virginia Bar Association, she serves as a chair of the Diversity Recruitment Committee, which organizes an annual Diversity Job Fair for law students interested in practicing in Virginia.
Ms. McCarroll received her law degree in 2000 from the University of Virginia School of Law, where she was the symposium editor of the Journal of Social Policy & the Law and the executive director of the Pro Bono Criminal Assistance Project. Ms. McCarroll was one of the few members of her class to receive the Pro Bono Service Award for meeting newly instituted requirements related to pro bono service. She graduated in 1994 from the College of William and Mary with a bachelor’s degree in government and spent a semester abroad at the University of Glasgow in Glasgow, Scotland.
Active in community as well as legal organizations, Ms. McCarroll is involved in The Community Foundation’s Impact 100 Program. She is a parishioner of St. Bridget Catholic Church and participates in the Junior Achievement’s annual Excellence Through Ethics Program.
