07.08.2011 Williams Mullen Obtains Class Decertification Beth Berman led a team of Williams Mullen's attorneys who assisted Dollar Tree Stores Inc. in decertifying a class of California store managers who accused the discount chain of misclassifying them as exempt managers, thereby denying them overtime pay, rest and meal breaks in violation of California law. California federal judge, Samuel Conti, who had previously certified the class, pointed to new developments in the law, in particular 9th Circuit case law and the Supreme Court decision in Dukes v. Wal-Mart, and ruled the lawsuit could no longer proceed as a class action. The judge stated, "Plaintiffs have failed to provide common proof to serve as the 'glue' that would allow a classwide determination of how class members spent their time."
