Landlords have become more aggressive in passing through expenses and retailers have stepped up their efforts to contest overcharges, resulting in more litigation. Lease provisions negotiated years or even decades earlier will influence decisions concerning whether to sue, who to sue, where to sue, what claims to include, case strategy, and available remedies. In addition, the current retail climate may present retailers opportunities to negotiate more favorable provisions in current leases. This program will focus on important lease provisions and strategic opportunities.
