In 2011, the U.S. Supreme Court rendered a number of decisions that have the potential to fundamentally alter the class action landscape. This CLE will focus on those decisions and their potential impact on class action litigation. Issues addressed will include arbitration clauses and class action waivers, heightened Rule 23(a) requirements, as well as the need for a Daubert analysis at the class certification phase of the proceedings. Additionally, the panel will look at the application of the Supreme Court’s ruling by lower courts.
