04.22.2009 Are You Prepared for the Lilly Ledbetter Fair Pay Act of 2009?
Almost immediately upon being sworn into office, President Barack Obama signed into law the Lilly Ledbetter Fair Pay Act of 2009. The statute is significant to employers because it enhances the ability of employees to pursue pay discrimination claims in federal courts by extending the period of time in which plaintiffs can seek recovery for pay discrimination. The statute also expands pay discrimination claims outside of Title VII to the Age Discrimination in Employment Act, The Americans with Disabilities Act and the Rehabilitation Act. It is the most significant statutory development in employment law since the 1991 amendments to Title VII and was passed in direct response to the United States Supreme Court’s decision in 2007 in Ledbetter v. Goodyear Tire & Rubber Co., Inc.
