02.01.2009 February 2009 Immigration Update: H-1B Deadline and Other News Affecting Your Business
02. 2009H-1B Application Deadline is April 1, 2009! We are rapidly approaching the April 1 filing deadline for new H-1B visas for the 2010 Fiscal Year. The H-1B visa program is used by U.S. businesses to employ foreign workers in specialty occupations that require theoretical or technical expertise in a specialized field and a bachelor’s degree or its equivalent, or a fashion model of distinguished merit and ability. The current annual cap on the H-1B category is 65,000 with some exceptions. The first 20,000 new H-1B visas for foreign workers with a master’s or higher level degree from a U.S. academic institution are exempt from the cap. However, because this Master’s Degree Category can also be oversubscribed, you should plan on filing any Master’s Degree H-1Bs on April 1, 2009.
