Burns Comments to Modern Healthcare on the Antitrust Implications of a Proposed Georgia Hospital Merger Jim Burns provided comments for Modern Health care regarding a proposed merger of two Georgia health systems. He explained that because the acquiring party, the Hospital Authority of Albany-Dougherty County, is an instrumentality of the state, its acquisition of Palmyra Medical Center would likely be exempt from the reporting obligations of the Hart-Scott-Rodino Act. He also noted that the ongoing antitrust lawsuit between Phoebe Putney Health System, which operates the Hospital Authority's other facilities, and Palmyra, which the parties announced would be settled as part of the transaction, would likely have no impact on the parties' ability to close their deal.
