On July 19, 2010, the U.S. District Court for the District of New Jersey issued an opinion holding that pharmaceutical sales representatives are properly exempt from the Fair Labor Standard Act’s overtime pay requirements as administrative employees. In opposing the defendant’s motion for summary judgment, the plaintiffs directed the Court’s attention to the Novartis Wage and Hour Litigation. The Court, however, declined to discuss that case, instead noting that the Third Circuit Court of Appeals has already held that pharmaceutical sales representatives are exempt administrative employees.
