Williams Mullen Assists 174 Power Global in Securing Virginia’s First Battery Energy Storage System Permits From the SCC

In August 2021, the Virginia State Corporation Commission (SCC) issued two Orders granting permits to Shockoe Solar LLC and Pigeon Run Solar LLC to construct and operate two, 20 MW battery energy storage system (BESS) projects. The BESS projects will be located in Pittsylvania County and Campbell County, Virginia, respectively.

The two BESS permits were the first permits issued by the SCC pursuant to the new Regulations Governing the Deployment of Energy Storage, 20 VAC 5-335-10 et seq. The BESS regulations were adopted by the SCC in December 2020 in accordance with the Virginia Clean Economy Act of 2020.

Shockoe Solar LLC and Pigeon Run Solar LLC are subsidiaries of Hanwha Energy USA Holding Corporation (d/b/a 174 Power Global). 174 Power Global and its affiliates have extensive experience in the development, construction and operation of photovoltaic solar energy generating facilities and BESS systems throughout the United States. 

The Williams Mullen team was led by Bob Riley and Brad Nowak, co-chairs of Williams Mullen’s Solar & Energy Storage team based in Tysons. Garland Carr, an energy partner based in Richmond, also worked on these proceedings for Shockoe Solar LLC and Pigeon Run Solar LLC. Other Williams Mullen team members who worked on these matters included Bob Perrow, an energy partner based in Richmond.
