Aaron Fadden
Aaron Fadden represents companies in complex intellectual property (IP) disputes and helps them protect and enforce their innovations in competitive markets.
His practice focuses on patent, trademark, and copyright litigation, where he advises clients through all stages of disputes, from pre-suit investigations to high-stakes enforcement and defense. He works with clients across a broad spectrum of industries and technologies, including chemistry, biotechnology, pharmaceuticals, life sciences, mechanical devices, safety devices, firearms, and advanced manufacturing, providing practical, business-focused guidance to safeguard and maximize the value of their IP assets. His experience includes:
- Patent, trademark, and copyright litigation, including infringement disputes and enforcement strategy
- Patentability and prior art analysis to evaluate innovation and filing strategy
- Freedom-to-operate (FTO) analyses to assess risk and support product development
- Infringement analysis and enforcement strategy, including drafting and responding to cease-and-desist letters
- Defending clients against claims by non-practicing entities (NPEs) and developing practical strategies to address nuisance patent assertions
- Patent prosecution, including U.S. non-provisional applications and design patent applications
Aaron also advises clients on intellectual property due diligence in connection with corporate transactions, including mergers, acquisitions, investments, and licensing arrangements. He evaluates the strength, scope, and ownership of IP assets, identifies potential risks and encumbrances, and provides practical guidance to support deal structuring and valuation.
Clients rely on Aaron to translate complex scientific concepts into clear legal strategies that align with business objectives. His technical background in chemistry and biochemistry allows him to quickly understand sophisticated technologies and provide actionable guidance on patent protection, risk mitigation, and competitive positioning.
Aaron also brings experience monitoring patent and market trends, helping clients stay ahead of competitors and identifying opportunities for innovation and portfolio growth.
He earned his J.D. from the University of North Carolina School of Law, where he served on the Board of Advisors for the UNC Institute of Innovation, was a member of the First Amendment Law Review, and served as president of the Carolina Intellectual Property Law Association. He holds an M.S. in Chemistry and a B.S. in Biochemistry from the Rochester Institute of Technology.
