As the son of farmers, Bennett is comfortable wearing many hats and understands the importance of tackling problems promptly and with a sense of practicality.

In his insolvency litigation practice, Bennett has experience representing secured and unsecured lenders in a variety of matters in state, bankruptcy and federal district courts. Specifically, Bennett has (a) tried collection cases, handled appeals, and enforced judgments in state court; (b) obtained relief from the automatic stay, obtained adequate protection for cash collateral, objected to disclosure statements and plans, challenged the dischargeability of debts, and defended preference and fraudulent conveyance actions in bankruptcy court; and (c) assisted with prosecuting loan enforcement actions and defending lender liability actions in federal court.

In his financial restructuring practice, Bennett has experience drafting default and demand letters, pre-negotiation agreements, forbearance agreements, security agreements and various other loan documents. Bennett also has experience assisting with the representation of debtor-in-possession financers in bankruptcy and receivers in receiverships.

In his commercial contracts practice, Bennett has experience negotiating the terms of a variety of vendor agreements and handling issues related to data processing, privacy and security, intellectual property rights, confidentiality and record retention.

In his homeowner community review practice, Bennett has experience negotiating the terms of lot purchase agreements, homeowner association declarations and organizational documents on behalf of homebuilders. Bennett also has experience reviewing title reports and subdivision plats for encumbrances affecting lots on behalf of homebuilders.

Bennett earned his Juris Doctor degree, cum laude, from Washington & Lee University School of Law, where he was the recipient of the James C. Turk ‘52 academic scholarship and was a semi-finalist in Washington & Lee’s annual mock trial competition. Bennett earned his Bachelor of Arts degree, magna cum laude, from Virginia Tech, where he majored in public relations, minored in political science and was a graduate of the University Honors Program.
