Project Development and Financing
Our team works with clients on project development, operations and financing issues from start to finish. We help clients effectively structure the project before it begins; apply for and secure all necessary permits; draft and negotiate engineering, procurement and construction (EPC) contracts; draft and negotiate power purchase and sale contracts; advise and help manage renewable energy credit (REC) purchases and sales; and more.
Our team also helps clients navigate zoning and land use policies and regulations to ensure their project is set up to succeed. We work with our Finance & Real Estate attorneys to handle real estate matters, public and private offerings of debt, project financings, tax-exempt financings and mortgage and asset-backed securities. We also work with our experienced Tax attorneys to help clients develop a beneficial tax plan for their project, which could include acquiring Production Tax Credits (PTCs), Investment Tax Credits (ITCs) and other state and federal tax incentives and other programs.
Energy and Environmental Regulatory Guidance
We frequently help clients navigate issues related to interconnection standards and contracts, and processes at the individual state level, as well as those set by the Federal Energy Regulation Commission (FERC). For clients pursuing solar rooftop installations, we have experience negotiating rooftop leases, access agreements and power performance guarantees.
Energy and Environmental regulations set by government entities like the Department of Energy (DOE) and the Environmental Protection Agency (EPA) can create multiple obstacles throughout a renewable energy project. Our team works hand-in-hand with our nationally recognized Environment & Natural Resources team to navigate each obstacle and help ensure projects maintain compliance at the federal and state level. We have experience representing clients in matters related to the Clean Air Act, the Clean Water Act and more.
